How Does an Employer of Record Work in Colombia?
An EOR in Colombia signs the employment contract through its own Colombian company. It then enrolls the employee with a pension fund, a health provider (EPS), an ARL and a family compensation fund.
Each month, the provider runs payroll in COP, withholds income tax, and files the contributions. It also pays the twice-yearly service bonus and deposits annual severance.
Contracts must also follow 2 recent changes. The 42-hour week under Law 2101 of 2021 has been in effect since July 15, 2026.
Under Law 2466 of 2025, night work now starts at 7 p.m. on Sundays, and holiday work carries a 90% surcharge from July 1, 2026, rising to 100% in July 2027.
I also raise a legal point with clients. Colombian law has no definition of an EOR, so the provider has to act as the real employer in practice, not only on paper.
The only regulated staffing route is the temporary staffing company (EST), and it covers only temporary assignments.
